16.04.140: PENALTIES:
Whoever being the owner, or agent of the owner, of any land located in the village or within the extraterritorial limits of the village, transfers, sells, or agrees to sell or negotiate to sell such land by reference to any exhibition of or by use of a plat or subdivision of such land before such plat has been approved as herein provided for in this chapter and recorded in the office of the Dona Ana County clerk, shall be deemed guilty of a misdemeanor. Upon conviction, he shall forfeit and pay a penalty of one hundred dollars ($100.00) for each lot transferred or sold, or agreed, or negotiated to be sold. The village, through its attorney or other designated official, may enjoin such transfer or sale or agreement by action for injunction or may recover the penalty by civil action. (Ord. 319 § 13, 2003)
