§ 91.41 ABOVE GROUND STORAGE.
   (A)   No tank, receptacle or other storage device used or intended to be used for the above ground storage of hazardous materials and having a storage capacity of 2,000 gallons or more, or, in the case of dry materials, 2,000 pounds or more, shall hereafter be erected, constructed or moved above ground upon any premises within the corporate limits of the city unless said tank, receptacle or storage device be located more than 750 feet from any residence, business, school or place open to the public and:
      (1)   The owner obtains authorization from the City Council; and
      (2)   The tank, receptacle or storage device meets the safety requirements of all applicable state, federal and local laws, ordinances, rules and regulations.
   (B)   Any tank, receptacle or other storage device in violation of this provision is hereby declared a nuisance subject to abatement according to the procedure in § 92.16 of this code.
