Any law enforcement officer may issue a civil infraction or misdemeanor ticket for any violation of this chapter.
(a) First Offense. A first offense of any provision of this chapter by a person shall be deemed a civil infraction and shall be punishable by a fine of fifty dollars ($50.00).
(b) Second Offense. A second offense during a twelve-month period shall be deemed to be a civil infraction and shall be punishable by a fine of one hundred fifty dollars ($150.00).
(c) Subsequent Offenses. Each subsequent offense in a twelve-month period shall be deemed a misdemeanor and shall be punishable by a fine of two hundred fifty dollars ($250.00) or up to ninety days in jail, together with costs of prosecution.
