(a) Any person aggrieved by a finding, notice or action taken under the provisions of this chapter may appeal to the City Manager.
(b) A written appeal to the City Council from the decision of the City Manager shall be filed by the aggrieved person with the City Clerk within ten days of the decision of the City Manager. The time and place for the hearing of the appeal shall be set by the City Council and written notice thereof given. The aggrieved person may present evidence to the City Council by way of the public hearing as to why the decision of the City Manager should not be upheld.
(c) The taking of an appeal to the City Council shall suspend the removal of any newsrack until the City Council makes its determination, unless, in the judgment of the City Manager, the newsrack presents a clear and present danger of imminent personal injury or property damage.
(d) Nothing contained in this section shall be interpreted to limit or impair the exercise by the City of its police power in the event of any emergency to remove any such newsrack.
