670.05   DISCHARGE OF INDUSTRIAL WASTE INTO HART LAKE OR CHIPPEWA CREEK.
   (a)   Definitions. As used in this section:
      (1)   "Industrial waste" means liquid waste, solids or semisolids from any type of food or fruit canning or processing plant and/or any other type of industrial process, as distinct from domestic sanitary sewage and cooling or condenser waters which have not come in contact with any substance used in or incidental to an industrial process.
      (2)   "Hart Lake" means the body of water located within the northern area of the corporate limits of the City of Hart and all tributaries, streams, drainage ditches or other types of natural drainage emptying into Hart Lake or into any of such tributaries within the City or within one-half mile of the corporate boundaries of the City.
      (3)   "Chippewa Creek" means the stream of water that terminates at the south boundary of East Main Street in the City and all tributaries, streams, drainage ditches or other types of natural drainage emptying into Chippewa Creek or into any of such tributaries within the City or within one-half mile of the corporate boundaries of the City.
      (4)   "Person" means any individual, firm, company, association, society, corporation or group.
   (b)   Discharge Prohibited. It shall be unlawful for any person to discharge into Hart Lake or into Chippewa Creek, either within the corporate limits of the City or within an area of land one-half mile from the corporate boundaries of the City, any industrial waste.
   (c)   Abatement of Nuisance. Any continued violation of this section by any person shall be deemed a public nuisance and may be abated by application for injunctive relief in any court of competent jurisdiction. This remedy shall be in addition to the penalty provided in Section 660.99.
