1173.09 ISSUANCE, REVOCATION, AND RENEWAL OF LICENSES.
   (a)   Notwithstanding anything in this Chapter 1173 to the contrary, any application for a license to operate a Marijuana Business shall be presented for recommendation to the City of Harrison Planning Commission and thereafter reviewed and approved by the City of Harrison City Council. A license, if approved, shall expire twelve (12) months from the date of the issuance of said license. Applications for subsequent renewal of the license shall be made to and approved by the Director the City provided that there is no significant modifications to the terms, conditions, or circumstance of the license have been proposed and there are no violations of the license, this Chapter 1173 or other City of Harrison laws, codes, statutes, or other regulations pertaining to the applicant of record. Violations of other City of Harrison laws, codes, statutes, or other regulations to be considered may include, for example and not by way of limitation, legitimate loitering complaints, excessive police calls to the immediate vicinity, noise complaints, and non-compliance with the terms of the license or Marijuana Controlled Operation Agreement. Applications for renewal of a license that do not qualify for administrative approval shall be reviewed and approved in the same manner as original applications for a license.
   (b)   Determination of eligibility for administrative renewal of a license shall be at the discretion of the City of Harrison City Council. A licensee shall apply for the renewal of an existing license not less than forty-five (45) days prior to the expiration date of said license. If a licensee submits a timely renewal application, the licensee may continue to operate its Marijuana Business until the application is finally acted upon by the City. A licensee who files an application to renew a license within forty-five (45) days prior to the date of the expiration of said license and also pays the requisite renewal fee and a non-refundable late application fee may continue to operate until the City has taken final action to approve or deny the licensee's application. No application for renewal of a license shall be accepted after the date of expiration date of said license.
   (c)    Notwithstanding anything in this Chapter 1173 to the contrary, any license for a Marijuana Business may be revoked by the City of Harrison City Council after a public hearing as to whether violations have occurred, or if the spirit and intent of the license has not been met.
   (d)   The City may charge fees for all applications contemplated under this Chapter 1173 and for the issuance and/or renewal of a licenses, including but not limited to, fees for the costs of background checks, copies of licenses, and for other changes to the license. Fees charged under this Section 1173.09(d) shall be determined and collected by the City pursuant to this Chapter 1173.
