1173.08 UNLAWFUL ACTS:
   (a)   It shall be unlawful for any Licensee to:
      (1)   Fail to comply with provisions of State Regulations pertaining to the operation of a Marijuana Business.
      (2)   Make a willful misrepresentation in applying for a license.
      (3)   Fail to surrender to the City the license when and as required.
      (4)   Fail to permit inspection/examination of books and records as required by law.
      (5)   Consume or permit the consumption of Marijuana on a property where a Marijuana Business is operated.
      (6)   Fail to report a transfer or change in ownership, or any new financial interest or investment in, any Marijuana Business.
      (7)   Display any signs or advertising that is in violation of any City law, code, statute, or other regulation or any State Regulations.
      (8)   Use advertising material that is misleading, deceptive, or false, that is designed to appeal to minors, or that is inconsistent with the legal and responsible use of Marijuana.
      (9)   Fail to maintain possession and control of the storefront from or upon which the Marijuana Business is operated.
      (10)   Sell, serve, dispense, or distribute any Marijuana or Marijuana infused product at any time other than between the hours of seven o'clock (7:00) A.M. and eleven o'clock (11:00) P.M., Monday through Sunday.
      (11)   Fail to report changes and apply for a modification of premises as required by city code and regulations.
      (12)   Sell or dispense Marijuana or marijuana-infused products to a person not physically present inside the premises upon which the Marijuana Business lawfully operates; provided however, that nothing in this section is intended to inhibit or prohibit the lawful sales and distribution of Marijuana and/or Marijuana-infused products to other Marijuana Businesses which hold all necessary licenses required to operate a Marijuana Business pursuant to applicable State Regulations.
      (13)   Fail to maintain compliance with current building and fire codes, including plumbing, electrical, and mechanical codes.
      (14)   Fail to report or disclose to the City any violation of, notice of violation of, or pending charges related to any State Regulation applicable to the operation of a Marijuana Business, or any suspension or revocation of any license or permit required to operate a Marijuana Business under any State Regulation.
      (15)   Fail to submit application for renewal of a license not less than forty-five (45) days prior to the date of the expiration of said license. A licensee who files a application to renew a license within forty-five (45) days prior to the date of the expiration of said license and also pays the requisite renewal fee and a non-refundable late application fee may continue to operate until the City has taken final action to approve or deny the licensee's application. No application for renewal of a license shall be accepted after the date of expiration date of the license.
   (b)   A violation of any provision of subsection (a) of this Section 1173.08 may result in the suspension or revocation of a License.
   (c)   A violation of any provision set forth in subsection (a) of this Section 1173.08, the sale cultivation, distribution, possession of Marijuana and/or Marijuana-infused products, and/or the operation of a Marijuana Business by any person who has not been granted a license, or by a licensee after the suspension or revocation of a license may result in criminal prosecution by the appropriate authorities.
   
   (d)   It shall be unlawful for any person to operate a Marijuana Business within the City of Harrison except in accordance with this Chapter 1173.
