(a) Business, commercial, and industrial buildings that have either been constructed or have begun construction at the time this legislation is enacted are exempt from its requirements unless the buildings subsequently undergo a significant redevelopment, renovation, expansion, or planned alteration, which is any change to the dimensions, materials, or square footage of any existing commercial building or its parking areas or grounds. Changes to the exterior color of a building must be in compliance with the provisions of Section 1169.02(b). Business, commercial, and industrial buildings whose plans are submitted after this legislation is enacted are subject to its provisions.
(b) Those developers, designers, and businesses whose plans for building materials, colors, and landscaping do not comply with these standards may have their proposals considered for a variance by the Harrison Board of Zoning Appeals (or the Harrison Planning Commission in the case of the Downtown Redevelopment District).
