939.17 MONTHLY WATER RATES.
   (a)   (1)   Effective with the November 1, 1985, billing, the following shall be the monthly rates for the supplying of water system service by the City.

      (2)   A meter reading shall be to the nearest 1,000 gallons consumed.
      (3)   The rates set forth above shall be increased each year on the anniversary date of the effective date of the billing period set forth in division (a)(1) above unless the Council of the City takes action by ordinance to cancel the increase in rates prior to the effective date as follows:

      (4)   The above rates shall apply to each single-family dwelling; house-trailer; mobile home; business or other like user of water and each unit of a duplex; double-house; apartment building; multi-purpose building; or other like use.
      (5)   The minimum charge-first two thousand gallons fee set forth in subsection (a) hereof for motels as defined in Section 939.11 shall be based upon 50% of the number of units available for occupancy at said motel.
      (6)   The deposit for service is required to be paid by residential homeowners and commercial users of water shall be fifty dollars ($50.00) payable at such time as the user of water service requests such service or at such time as service is actually furnished, whichever occurs first. This deposit may be returned to the customer after one year of good standing as a Harrison municipal water customer. A member of good standing requires that there be a zero balance at the time of the request for the deposit to be returned and that at no time has the customer been delinquent in its payments of its utility bills to the City of Harrison.
      (7)   The deposit for service is required to be paid by renters and leaseholders of property shall be two hundred dollars ($200.00) payable at such time as the user of water service requests such service or at such time as service is actually furnished, whichever occurs first.
All deposits will be applied to the final bill. A refund will be issued if and overage of five dollars ($5.00) or more is remaining from the deposit.
   (b)   With the only exceptions being those so stipulated in Section 939.18 to 939.20, the above rates and charges shall be applied as follows:
      (1)   Inside corporation limits.
         A.   The foregoing rates shall apply to all users of the water system.
         B.   A single user, metered as such, shall be billed on the metered water consumption.
         C.   Where one meter is used to meter water consumption collectively for:
            1.   One or more apartment buildings;
            2.   One or more multi-tenant buildings;
            3.   One or more multi-purpose buildings;
            4.   A house-trailer or mobile home court or park, or any combination thereof;
         D.   The monthly charge shall be the greater of:
            1.   The number of users times the minimum rate; or
            2.   If the metered water consumption is in excess of the number of users times 2,000 gallons (minimum), the charge shall be the number of users times the minimum rate plus the applicable rate for water consumption in excess of the total allowable minimum gallonage.
         E.   When required, the owner, lessee, or manager of the aforementioned users shall advise the City Utilities Office of the number of users located therein or thereon for one day or more of a given billing period.
      (2)   Outside corporation limits. The rates for those users located outside the corporation limits shall be the rates as set forth for users located within the City, plus 30%, except those users under separate contract with the City of Harrison, in which event the rate set forth in the contract shall apply.
   (c)   This subchapter shall not apply, in any manner, to the existing contract between the City and the Harrison Township Water Corporation for the supplying of water by the City to the Harrison Township Water Corporation, or, to any future contracts of this type.
