§ 51.02 MANDATORY WATER HOOKUP.
   (A)   Each household and/or business within the town limits shall be required to subscribe to the municipal water system as it becomes available in that area. To “subscribe” as used in this section means either to hook onto and use the municipal water system or pay the fees and deposits for availability of the municipal water system, as set forth below. Any such household and/or business which is using the municipal sewer system must use the municipal water system.
   (B)   If a household and/or business within the town limits has an approved private water system, such as a well, which services that household or business, that household or business may continue to use its private water system, so long as the household or business pays to the town the following fees and deposits:
      (1)   Refundable water bill deposit;
      (2)   Account set up fee;
      (3)   Standard connection charge; and
      (4)   Monthly minimum water provisions fee.
   (C)   Payment of the fees and deposits described in division (B) above shall be on such terms as the town may direct. The amount of such fees and deposits shall be the prevailing rate or charge set forth from time to time by the town.
   (D)   Notwithstanding any other ordinance relating to the water system, failure to timely pay these fees and deposits and/or any penalty imposed by the water system ordinances for noncompliance or violation shall subject the subscriber to termination of any other utility services provided by the town. These remedies shall be in addition to any other remedy available to the town.
