§ 51.56 DEGREE OF HAZARDS.
   (A)   No service shall be completed until the town has been provided information or has surveyed the private water system to determine the degree of hazard and make a determination of a backflow prevention assembly to be installed to protect the public water supply.
   (B)   Any customers making any modification to their private exterior or interior water configuration and/or changing the usage of the exterior or interior water system, which may change the degree of hazard, shall notify the town before any modification is made. If the town determines that such modification required a different backflow prevention assembly, that assembly must be installed before the modification is made or the usage is changed.
   (C)   The following types of facilities or services have been identified by the town as having a potential for backflow or non-potable water into the public water system. Therefore, an approved backflow prevention assembly will be required on all such services according to the degree of hazard present. Other types of facilities or services not listed in this section may also be required to install approved backflow prevention assembly if determined necessary by the town. As a minimum requirement, all commercial services will be required to install double check valve assembly unless otherwise listed as follows:
      (1)   RP = Reduced pressure assembly;
      (2)   DCVA = Double check valve assembly;
      (3)   DCDA = Double check detector assembly;
      (4)   RPDA = Reduced pressure detector assembly;
      (5)   AG = Air gap;
      (6)   Automotive service stations, dealerships and the like:
         (a)   No health hazard: DCVA; and
         (b)   Health hazard: RP.
      (7)   Automotive plants: RP;
      (8)   Auxiliary water system:
         (a)   Approved public/private water supply: DCVA;
         (b)   Unapproved public/private water supply: AG; and
         (c)   Used water and industrial fluids: RP.
      (9)   Bakeries:
         (a)   No health hazard: DCVA; and
         (b)   Health hazard: RP.
      (10)   Beauty shops/barber shops:
         (a)   No health hazard: DCVA; and
         (b)   Health hazard: RP.
      (11)   Beverage bottling plants: RP;
      (12)   Breweries: RP;
      (13)   Buildings - hotels, apartment house, public and private building or other structures having unprotected cross-connection:
         (a)   (Under five stories) no health hazard: DCVA;
         (b)   (Under five stories) health hazard: RP; and
         (c)   (Over five stories) all: RP.
      (14)   Canneries, packing house and rendering plants: RP;
      (15)   Chemical plants - manufacturing, processing, compounding or treatment: RP;
      (16)   Chemically contaminated water system: RP;
      (17)   Commercial car - wash facilities: RP;
      (18)   Commercial greenhouses: RP;
      (19)   Concrete/asphalt plants: RP;
      (20)   Dairies and cold storage plants: RP;
      (21)   Dye works: RP;
      (22)   Film laboratories: RP;
      (23)   Fire system:
         (a)   No health hazard: DCVA; and
         (b)   Health hazard (booster pumps, foams, anti-freeze solution and the like): RPDA.
      (24)   Hospitals, medical building, sanitarium, morgues, mortuaries, autopsy facilities, nursing and convalescent homes, medical clinics and veterinary hospitals: RP;
      (25)   Individual commercial sales establishment (department stores):
         (a)   No health hazard: DCVA; and
         (b)   Health hazard: RP.
      (26)    Industrial facilities:
         (a)   No health hazard: DCVA; and
         (b)   Health hazard: RP.
      (27)   Laundries:
         (a)   No health hazard: DCVA; and
         (b)   Health hazard (i.e. dry cleaner): RP.
      (28)   Lawn irrigation system: health hazard: RP;
      (29)   Mall or strip malls (frequent tenant change and photo labs and the like): health hazard: RP;
      (30)   Metal manufacturing, cleaning, processing and fabricating plants: RP;
      (31)   Mobile home parks:
         (a)   No health hazard: DCVA; and
         (b)   Health hazard: RP.
      (32)   Oil and gas production, storage or transmission properties: RP;
      (33)   Paper and paper products plants: RP;
      (34)   Pest control (exterminating and fumigating): RP;
      (35)   Plating plants: RP;
      (36)   Power plants: RP;
      (37)   Public swimming pools: RP;
      (38)   Radioactive materials or substances - plants or facilities handing: RP;
      (39)   Restaurants:
         (a)   No health hazard: DCVA; and
         (b)   Health hazard: RP.
      (40)   Restricted, classified or other closed facilities: RP;
      (41)   Rubber plants (natural or synthetic): RP;
      (42)   Sand and gravel plants: RP;
      (43)   Schools and colleges: RP;
      (44)   Sewage and storm drain facilities: RP;
      (45)   Waterfront facilities and industries: RP; and
      (46)   All assemblies and installations shall be subject to inspection and approval by the town.
   (D)   Filling of tanks/tankers or any other container from a town fire hydrant is strictly prohibited unless it has been equipped with the proper meter and backflow protection, at which the town will issue a permit for that tank/tanker or container. Any unauthorized connection to a fire hydrant is considered an illegal cross-connection to the town water system and will be subject to fines. All tanks/tankers shall be inspected by the Operator in Responsible Charge (ORC) of Backflow and Cross-Connection Prevention.
   (E)   If a Cross-Connection Control Inspector is unable to survey any portion of a private exterior or interior water system to determine the degree of hazard, due to confidential activities, a reduced pressure assembly will be required. A violation of this section is punishable as a misdemeanor.
