§ 151.096 OFF-PREMISES OUTDOOR ADVERTISING SIGNS.
   (A)   Off-premises outdoor advertising signs may be installed within the areas under the control of the State of Texas along the Interstate Highway 14/U.S. Highway 190 (Central Texas Expressway) corridor. Such signs shall be subject to the applicable provisions of Chapter 391 of the Texas Transportation Code, as well as the permit requirements of this chapter and of the state.
   (B)   Off-premises outdoor advertising signs may be installed upon lands abutting the Business Highway 190 (Veterans Memorial Boulevard) subject to the following conditions:
      (1)   Maximum sign area shall not exceed 300 square feet.
      (2)   Maximum height shall not exceed 35 feet as measured from adjacent road grade.
      (3)   Signs shall be spaced no closer to each other than 1,000 feet apart along the same side of the roadway. This shall be a linear measure along the centerline of the roadway.
      (4)   Signs shall not be erected closer than 1,000 feet to any public recreational area, church, school, residentially zoned area, or any scenic area so designated by a governmental authority.
   (C)   Off-premises outdoor advertising signs shall be permitted on any vacant property that abuts a principal arterial, minor arterial, or collector (as those terms are defined in the Mobility 2030 Thoroughfare Plan) subject to the following conditions:
      (1)   Only one such sign shall be allowed on any public street frontage of the premises at any one time.
      (2)   A sign permit shall be required for the new installation of any such sign and for the relocation of any such sign on the same premises. The sign permit shall be valid for six months and shall be eligible for renewal so long as it remains in compliance with all conditions within this code.
      (3)   Such signs shall not exceed 32 square feet in area or six feet in height.
      (4)   The sign may not be illuminated and may not be a changeable electronic variable message sign.
   (D)   No off-premises outdoor advertising sign shall be designed or used in such a way as to constitute an on-premises business identification sign as herein defined. This requirement applies whether or not a business activity began operations prior to or subsequent to the erection of the sign.
