§ 113.99 PENALTY.
   Any person who violates any provision of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine in an amount to be set by the judge. Provided, however, if such person is convicted of an offense under this chapter which offense is also a violation of Tex. Health & Safety Code § 431.021, such person shall be subject to a fine in an amount to be set by the judge; and for the second or subsequent offense shall be subject to a fine of not less than $100 nor more than $1,000. However, nothing in this chapter shall be construed as requiring the Health Officer to report minor violations of this chapter for prosecution whenever the Health Officer believes the public interest will be adequately served in the circumstances by a warning.
