§ 33.91 MEMBERSHIP; FILLING VACANCIES; REMOVAL.
   (A)   The term of the members of the Commission shall be for three years or until their respective successors are appointed and have qualified. No member shall serve more than two full consecutive terms on the Commission.
   (B)   The Commission shall include one voting member of the City Council. The Harker Heights Chamber of Commerce shall nominate one chamber member in good standing to serve as one voting member. The City Manager shall appoint one city staff member to serve as a non-voting administrative support member of the Commission.
   (C)   The City Council member shall be appointed to the Committee by the Mayor on an annual basis and shall serve at the pleasure of the Mayor. The Mayor shall appoint a replacement to any vacancy in that position to fill the unexpired term.
   (D)   During the month of September of each year, or as soon thereafter as is reasonable practicable, the City Council shall appoint members to fill all vacancies expected to occur on the Arts Commission during the succeeding 12-month period. The term of each member shall begin on January 1 of the following year in which the member was appointed.
   (E)   For purposes of the initial appointments, two members shall be appointed for a three year term, two members shall be appointed for a two year term, one member shall be appointed for a one year term. Those initial members appointed for terms of less than three years shall be considered to have served partial terms, and shall be eligible to serve two full terms subsequent to the completion of their respective initial appointments.
   (F)   Commission members may be removed at any time, with or without cause, upon the affirmative vote of a majority of the City Council.
   (G)   For the purpose of filling vacancies, the Commission may submit names for each Commission vacancy to the City Council. The City Council may appoint Commission Members from the recommended list or from applications made directly to the City Secretary.
   (H)   The City Council may appoint two alternate members to the Commission. Alternates shall serve in the order specified by the City Council, and a person named as an alternate shall be eligible until January 1 following the expiration of one year from the date such person was named as an alternate. Immediately following a vacancy, and without the necessity of further action by the City Council, the first eligible alternate shall take the oath of office and begin to serve the unexpired term of his or her predecessor. To maintain a quorum, an alternate member may serve as a voting member in the absence of one or more regular members when requested to do so by the Chair. Such alternates shall serve in the order in which they were appointed and must be a member in good standing: acting in compliance with all explicit obligations, while not subject to any form of sanction, suspension, or disciplinary censure. An alternate member vacancy shall be filled in the same manner as a vacancy among the regular members.
