§ 102.02 DIRECTOR’S AUTHORITY.
   (A)   The Director shall have the responsibility to plant, prune, maintain and remove public trees.
   (B)   The Director may, with the consent of the property owner, treat, remove or prune a private tree that is dead, diseased or otherwise in need of maintenance. If applicable, the Director shall first obtain written findings from the City Council in accordance with Tex. Health & Safety Code Ch. 756, Subch. G.
   (C)   The Director shall have the right to treat, prune or remove a private tree that exists in violation of any provision of this code, that harbors insects or disease which threatens other trees, or that otherwise presents a serious danger to persons or property. The city shall have a lien against the property upon which such tree was located to secure the payment of all expenses associated with such treatment, pruning or removal. Such action by the Director shall have no effect on a prosecution for a violation of any provision of this chapter.
   (D)   The Director may exercise the authority of the Operations Manager under § 96.71.
