§ 104.21 COMPENSATION TO CITY.
   (A)   Right-of-way fee. An operator must pay compensation to the city for use of the rights-of-way in the amount of $250 annually per small cell facility, or such higher amount as may be authorized by Texas Local Government Code § 284.054, as amended, based on changes in the consumer price index after the effective date of this section.
   (B)   Attachment fee. An operator who attaches small cell facilities to city-owned wireless support structures must pay compensation to the city in the amount of $336 per attachment per year for use of a city-owned wireless support structure.
   (C)   Other fees. The application fee specified in this subchapter and the fees authorized by this section shall be the sole compensation, direct or indirect, that an operator shall be required to pay to the city in connection with the ownership, placement, operation and use of small cell facilities, including any and all services provided pursuant to the facility or facilities. However, compensation for attachment to municipally-owned utility poles shall be governed by state law.
