(A) Generally. The installation of any equipment not described in or included in an approved application is prohibited. The operator must, at its own cost and expense, maintain the wireless facilities and licensee poles in good order and condition, and keep same reasonably safe and clean, and in accordance with applicable law and the requirements promulgated by the Director, as such may be amended from time to time. Whether permitted or not, the wireless facilities and licensee poles may not render the right-of-way non-compliant with applicable law. The operator’s work shall be subject to the regulation, control and direction of the Public Works Director. All work done in connection with the installation, operation, maintenance, repair, modification and/or replacement of the wireless facilities and licensee poles must be performed in a good and workmanlike manner, and in compliance with applicable law.
(B) Tree maintenance. The operator, its contractors and agents must obtain written permission from the Director before trimming trees hanging over its licensee poles to prevent branches of such trees from contacting attached wireless facilities or the licensee poles. The operator shall trim under the supervision and direction of the Director. The city shall not be liable for any damages, injuries or claims arising from the operator’s actions under this section.
