§ 104.16 PLACEMENT OF FACILITIES.
   (A)   Locations. Subject to the requirements of this subchapter, small cell facilities may be placed on the rights-of-way and on city-owned wireless support structures in the rights-of-way. Licensee poles and ground equipment in the right-of-way must be placed, as much as possible, within two feet of the outer edge of the right-of-way line. Licensee poles and wireless facilities must not impede pedestrian or vehicular traffic in the right-of-way. The operator may request from the Director a waiver of underground construction requirements to allow for “microtrenching”, at a depth of less than 24 inches for lateral connections connecting wireless facilities to the fiber-optic network.
   (B)   Parks.
      (1)   Placement of wireless facilities and licensee poles in any parks is prohibited, unless dedicated as right-of-way and the placement complies with applicable law, private deed restrictions, and other public or private restrictions on the use of the park.
      (2)   An operator must not install ground equipment in a right-of-way that is within 150 feet of the boundary line of a park, unless approved by the Director in writing.
      (3)   An operator must not install a licensee pole in a right-of-way that is within 300 feet of the boundary line of a park, unless approved by the Director in writing.
   (C)   Traffic signals. An operator must neither allow nor place a wireless facility on a traffic control device or traffic signal, or any structure supporting a traffic control device or traffic signal.
   (D)   City infrastructure. An operator must neither allow nor install wireless facilities and licensee poles on any part of a city bridge, overpass or tunnel, unless approved by the Director in writing.
   (E)   Streets. An operator must neither allow nor install licensee poles or ground equipment in a right-of-way that is adjacent to a street or thoroughfare that is 50 feet or less in width, if both sides of the street or thoroughfare are adjacent to exclusively single-family residential lots, unless approved by the Director in writing.
   (F)   Schools. An operator must adhere to the federal radio frequency (RF) emissions standards set forth in Federal Communications Commission OET Bulletin 65 (as amended), when installing or allowing installation of wireless facilities or licensee poles within 150 feet of a school.
   (G)   Deviations. In the event that the actual locations of any facilities deviate in any material respect at the locations identified in the plans, drawings and specifications submitted with the application, the operator must notify the city immediately after the completion of the permitted work.
