§ 104.13 PERMIT REQUIRED; APPLICATIONS AND FEES.
   (A)   Permit required. A permit is required to install or collocate a small cell facility in the rights-of-way, except as otherwise provided in this subchapter. An applicant seeking to construct, modify or replace a network of small cell facilities may, at the applicant’s discretion, file a consolidated application and receive a single permit for multiple small cell facilities.
   (B)   Permit application. All applications pursuant to this subchapter must be filed on a form provided by the city. The applicant may designate material as “proprietary” or “confidential” by clearly marking each page of such materials accordingly, subject to the city’s obligations under the Public Information Act and other applicable law.
   (C)   Application requirements. Prior to installation or modification of a wireless facility or licensee pole, the operator must complete and submit to the Director a complete application and plan review form for location review, together with:
      (1)   A one-time, nonrefundable, reasonable, cost-based plan review fee, in the amount stated in the most recent city fee schedule, not to exceed the fees charged to other persons performing work in the rights-of-way;
      (2)   A general description of the proposed work, the purposes and intent of the facility, and the uses to which the facility will be put, with the scope and detail of the description being appropriate to the nature and character of the work to be performed, and with special emphasis on those matters likely to be affected or impacted by the work proposed;
      (3)   A map showing the intended location of the wireless facility or licensee pole, and its distance from a historic landmark, park or school, if any;
      (4)   Representative drawings or pictures of the intended wireless facility or licensee pole;
      (5)   Engineering and construction plans and drawings; and
      (6)   Written confirmation of an agreement between the wireless carrier and the applicant for the carrier to use the wireless facility or licensee pole, if applicable.
   (D)   Code compliance. The operator must provide the city with an evaluation of a structural engineer, indicating the proposed small cell facility passes the wind-force and ice-load standards required by this subchapter.
   (E)   Routine maintenance and replacement. An application is not required for:
      (1)   Routine maintenance; or
      (2)   The replacement of a small cell facility with another small cell facility that is substantially similar or smaller in size, weight and height, and that has the same or less wind-, ice- and structure-loading characteristics.
   (F)   Information updates. An amendment to information contained in a permit application must be submitted in writing to the Director within 30 days after any information contained in a prior application becomes inaccurate, incomplete or misleading.
