§ 30.04 NUMBER OF MEMBERS.
   (A)   Number of Council members.
      (1)   The number of Council members shall be five and be composed of the following: existing Council seats from district one, district two, and district three.
      (2)   Each Council Member must be a resident of the district he or she represents and is voted on by the town as a whole. The three district boundaries shall be as presently prescribed by ordinance of the town or as hereinafter amended. New Council seats include: at large one - the whole of town; and at large two - the whole of town.
   (B)   Selection of Council members.
      (1)   The Council seats of district one, district two, and district three shall be filled by the individuals receiving the winning vote total from the November 4, 2003 ballot for each existing Council seat. Additionally, it is understood that due to § 30.05, a section adopting staggered terms for Council members, that:
         (a)   The two individuals receiving the highest vote totals in the balloting for at large one and at large two of the Town Council shall be elected to serve an initial three-year term on the Town Council beginning at noon on January 1, 2004;
         (b)   The individuals receiving winning vote totals in the balloting for districts one, two, and three of the Town Council shall be elected to serve a four-year term on the Town Council beginning at noon on January 1, 2004. Districts one, two, and three shall be as presently or hereinafter comprised under ordinances of the town; and
         (c)   All successors to the Council members elected on November 4, 2003 shall be elected to serve terms of four years.
      (2)   The new Council seats, at large one and at large two, shall be filled by the members of the Council at a regular or special meeting. The Town Council may fill the vacancies before this section takes effect.
         (a)   The individuals appointed to the Council seats of at large one and at large two shall serve a one-year term, beginning January 1, 2003 and until their successors are elected and sworn in.
         (b)   The Clerk-Treasurer shall give notice of the meeting to fill the vacancies, which shall be held in the time frame dictated by I.C. 3-13-9-4.
         (c)   The notice must:
            1.   Be in writing;
            2.   State the purpose of the meeting;
            3.   State the date, time, and place of the meeting; and
            4.   Be sent by first class mail to each Council member at least ten days before the meeting.
