§ 154.101 AUTHORITY AND TITLE.
   (A)   This chapter is adopted in accordance with statutory authority granted to Hancock County under "Home Rule", and further required by Phase II of the National Pollution Discharge Elimination System program (FR Doc. 99-29181) authorized by the 1972 amendments to the Clean Water Act, the Indiana Department of Environmental Management's (IDEM) Municipal Separate Storm Sewer System (MS4) General Permit (MS4 GP) and Construction Stormwater General Permit (CSGP). Based on this authority and these requirements, this chapter regulates:
      (1)   Discharges of prohibited non-stormwater flows into the storm drain system;
      (2)   Stormwater drainage improvements related to development of lands located within Hancock County;
      (3)   Drainage control systems installed during new construction and grading of lots and other parcels of land;
      (4)   Erosion and sediment control systems installed during new construction and grading of lots and other parcels of land;
      (5)   The design, construction, and maintenance of stormwater drainage facilities and systems;
      (6)   The design, construction, and maintenance of stormwater quality facilities and systems;
      (7)   The design, construction, and maintenance of new dams;
      (8)   The development downstream of existing dams; and
      (9)   Development within floodways and fluvial erosion hazard corridors.
   (B)   This chapter shall be known and may be cited as the “Hancock County Stormwater Management Ordinance.”
