§ 119.022 PRODUCER OR HUCKSTER; LICENSE REQUIRED.
   (A)   No producer or huckster shall engage in his or her business in a public market or market place within the corporate limits of the city without first having obtained a licence therefor from the City Clerk. Application for a producer’s license to engage in business in a public market or market place shall be made in writing upon blanks furnished by the City Clerk, giving the name, age, address and previous experience of the applicant, the names and kinds of the products he or she produces and intends to sell at the market, the place where he or she raises the products, the names of all persons in his or her employ who shall appear at the market to sell the products the names of all persons employed by him or her at the premises where he or she raises the products and any other information as may be deemed necessary for the protection of the public welfare and the proper enforcement of this subchapter, together with an agreement that, if license is granted to him or her, he or she will not allow or permit anyone to sell his or her products in a market other than the members of his or her immediate family or the persons actually employed by him or her in the raising of produce and that a violation of the agreement shall be sufficient cause for the revocation of his or her license. The City Clerk may require all information to be sworn to be the applicant. The application shall be referred to the health officer who shall make an investigation and recommendation to the City Clerk within a reasonable time after receiving the application. If the City Clerk if satisfied that the applicant is a suitable person to engage in the business, has not been convicted of any felony, or the offense of short weight, or been barred from any public market, he or she shall grant the license and issue the same upon the payment to the City Treasurer of the license fee of $1.
   (B)   Application for huckster’s license shall be made in writing upon blanks furnished by the City Clerk, giving the name, age, address and previous experience of the applicant, the names and kinds of the products he or she intends to sell at the market and any other information as may be deemed necessary for the protection of the public welfare and the proper enforcement of this subchapter. The City Clerk may require all information to be sworn to by the applicant. The application shall be referred to the health officer who shall make an investigation and recommendation to the City Clerk within a reasonable time after receiving the application. If the City Clerk is satisfied that the applicant is a suitable person to engage in the business, has not been convicted of a felony, or the offense of short weight, or been barred from any public market, he or she shall grant a license and issue the same upon the payment to the City Treasurer of the license fee of $25.
   (C)   At the time of the issuance of the license, the City Clerk shall give to each producer or huckster a suitable plate to be displayed by the licensee in a conspicuous place at the stall where he or she engages in his or her business in the public market. No producer or huckster shall operate more than one stall under one license.
