No person shall establish or conduct a public market or market place as herein defined within the corporate limits of the city without first having obtained a license from the City Clerk. Application for the license shall be made in writing to the City Clerk and shall be upon printed blanks to be furnished by the City Clerk, which shall set forth, among other things, the place where the business is to be conducted, the name, age, residence and previous experience of the applicant. If the applicant be a partnership, the names and addresses of all partners and the name under which the business is to be conducted shall be given. If the applicant is a corporation, the names and addresses of all the officers and the name of the corporation shall be given. The application shall, before the issuance of the license, be referred to the health officer, who shall make an investigation and recommendation to the City Clerk within a reasonable time after the filing of the application. If the City Clerk is satisfied that the applicant is a suitable person to conduct a public market or market place, has never been convicted of a felony, that the proposed public market or market place is equipped with one automatic dial scale of 300 pounds capacity and one computing scale of 100 pounds capacity, sealed by the Sealer of Weights and Measures (the scales to be located for the convenience of customers in checking the weights of purchases), then he or she shall grant the license upon the payment to the City Treasurer of a license fee in the amount of $200 and the filing with the City Clerk of a surety company bond in the amount of $1,000 conditioned for the faithful observance of the terms of this subchapter or any ordinance amendatory thereof or supplemental hereto. Provided, however, that no license shall be granted to any person, firm, partnership or corporation to operate or conduct a public market or market place within a radius of 2,000 feet of any other market or market place licensed under the provisions of this subchapter.
