§ 118.070 LICENSE REQUIRED; FEE.
   No person or persons, company or companies, shall exhibit or maintain in the city, any circus, menagerie, carnival, play, game or theatrical exhibition, or give any concert, vocal or instrumental or exhibit any natural or artificial curiosity, or give a show of any kind for which pay is demanded or received, without first obtaining a license from the City Clerk of the city, and for any license granted for any business, purpose or object herein specified there shall be collected in advance from the person or persons, firm or corporation receiving the same the following fee.
   (A)   The license fee for a circus or menagerie, or both, where an admission fee is charged, shall be $150 for the first day upon which an exhibition shall occur and $100 for each subsequent day.
   (B)   (1)   The license fee for a carnival or open-air exhibition which consists of or comprises an aggregation of amusements, exhibitions, shows, games and like amusements, shall be the sum of $25 per day, to be paid in advance; and, before the granting of a permit for the exhibition or carnival, the management thereof shall submit to the Director of Public Works of the city a schedule or list of the amusements, exhibitions, shows, games and like amusements comprising the carnival or exhibition, and the Director of Public Works shall examine the same and make investigation thereabout and if satisfied that the amusement, exhibitions, shows, games and like amusements are proper, shall endorse the application with his or her approval, but unless the approval be endorsed upon the application no license for the carnival or open air exhibition shall be issued by the City Clerk. The payment of the sum of $25, as aforesaid, shall be held to cover and include the license fee otherwise chargeable for each amusement, exhibition, show, game and like amusement operated in connection with the carnival or open air exhibition.
      (2)   Provided, that before any license shall be granted under divisions (A) or (B) of this section there shall be deposited by the applicant for the license, with the City Clerk, a cash bond of not more than $500 conditioned that no damage will be done to the streets, sewers, trees or adjoining property, and that no dirt, paper, litter or other debris will be permitted to remain upon the streets or upon any private property by the licensee, and containing other conditions as the City Clerk may require. The City Clerk shall fix the amount of the bond up to $500 depending upon the nature and size of the property equipment of the applicant, the length of haul and other pertinent facts.
   (C)   The license fee for a zoological garden, permanently located and established in the city shall be the sum of $25 annually.
   (D)   The license fee for all baseball parks or grounds, where professional baseball is played, shall be the sum of $25 annually.
   (E)   The license fee for a play or theatrical exhibition, except as hereinafter specified, shall be the sum of $10 for the first day and $5 for each subsequent day.
   (F)   The license fee for a concert, vocal or instrumental or operatic performance, shall be $10 for the first day and $5 for each succeeding day.
   (G)   The license fee for concert, vocal or instrumental or operatic performances, moving pictures, vaudeville acts, minstrel show or other form of entertainment given in the open air or in a tent within the limits of the city shall be $15 a month, the sum payable in advance and the license to be granted for the term of four months only; provided, that during the performance of any of the above enumerated entertainments, no articles, souvenirs or prizes shall be sold, donated or given away for advertising purposes; and provided further, that during the rendition of any show as above enumerated it shall be unlawful to advertise, give away or sell any medicine, salve, lineament or other ingredient for the cure of the ailment of man or beast.
   (H)   The license fee for a museum permanently located and established in the city shall be the sum of $50 annually in advance.
   (I)   The license fee for a museum temporarily located in the city shall be the sum of $10 for the first day and $5 for each succeeding day.
   (J)   The license fee for a whirligig, merry-go-round, shooting gallery or games of like character, permanently located in the city shall be the sum of $50 annually in advance.
   (K)   The license fee for a whirligig, shooting gallery or games of like character, temporarily located in the city, shall be the sum of $10 for the first day and $5 for each succeeding day.
   (L)   The license fee for the exhibition of any natural or artificial curiosity shall be the sum of $10 for the first day and $5 for each succeeding day.
   (M)   The license fee for all observation stands shall be the sum of $100 annually, payable in advance.
   (N)   The license fee for roller and ice skating rinks, penny exhibits and phonographic exhibits, permanently located in the city, shall be the sum of $50 annually, payable in advance.
   (O)   The license fee for roller and ice skating rinks, penny exhibits and phonographic exhibits, temporarily, located in the city, shall be the sum of $10 for the first day and $5 for each succeeding day.
   (P)   The license fee for all concert, musical and lecture halls shall be the sum of $50 annually, payable in advance; provided, that the sum so paid shall be in lieu of any other sum required to be paid for a license, for any performance, theatrical, musical or otherwise, that may occur therein.
   (Q)   The license fee for moving picture shows and all shows of a like character, permanently located with the city, shall be the sum of $25 per show for shows having a capacity of not more than 500 persons. The license fee for all shows with a larger seating capacity than 500 persons shall be $25 per annum plus $5 for each additional 100 seats, or fraction thereof, over 500. Provided, however, that the maximum license fee for the shows shall be $50 per annum. All applications for licenses for moving picture shows and all shows of like character shall specify the number of seats in each show for which a license is desired and all statements contained in the application shall be subscribed and sworn by the applicant before a notary public.
   (R)   The license fee for all opera houses and play houses where theatrical, dramatic and operatic, or so-called vaudeville or burlesque shows are given, shall be the sum of $100 annually, payable in advance. Provided, that the sum so paid shall be in lieu of any other sum or sums of money required to be paid for a license, for any performance, theatrical, musical or otherwise that may occur therein.
   (S)   The license fee for all amusement parks or amusement places, maintaining and operating six or more than six kinds or variety of exhibits, shows or amusements, shall be the sum of $1,000 annually, payable in advance.
   (T)   The license fee for any public entertainment or amusement not already designated, and for which pay is demanded or received, shall be the sum of $10 for the first day and $5 for each succeeding day.
