§ 91.007 ENFORCEMENT; SEIZURE.
   (A)   The City Fire Marshal, Fire Chief, or their respective designee(s), or sworn law enforcement officers of the city are authorized to enforce the provisions of this chapter.
   (B)   If the City Fire Marshal, Fire Chief, or their respective designee, or a sworn law enforcement officer of the city, determines that a violation of this chapter has occurred, the Fire Marshal, Fire Chief, or designee, or sworn officer may seize the consumer fireworks as evidence of the violation.
   (C)   Following a final disposition of an appeal of a conviction under this act, the seizing agency may dispose of or destroy any fireworks retained as evidence in that prosecution.
      (1)   A person from whom fireworks are seized under this act shall pay the actual costs of storage and disposal of the seized fireworks if found guilty, responsible, or liable for a violation under this act.
   (D)   The seizing agency may use fireworks described in this section for training purposes.
