§ 91.999 PENALTY.
   (A)   Unless otherwise provided in above, if a person violates this chapter, the person is guilty of a crime as follows:
      (1)   Except as otherwise provided in this section, a misdemeanor punishable by imprisonment for not more than 30 days or a fine of not more than $1,000, or both.
      (2)   If the violation causes damage to the property of another person, a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not more than $5,000, or both.
      (3)   If the violation causes serious impairment of a body function of another person, a felony punishable by imprisonment for not more than five years or a fine of not more than $5,000, or both.
      (4)   If the violation causes the death of another person, a felony punishable by imprisonment for not more than 15 years or a fine of not more than $10,000, or both.
   (B)   In addition to any other penalty imposed for the violation of this act, a person that is found guilty of a violation of this chapter shall be required to reimburse the appropriate governmental agency for the costs of storing seized fireworks that the governmental agency confiscated for a violation of this chapter. This reimbursement shall be in a form and at a time as required by the City of Hamtramck and as otherwise required by law.
