§ 53.009 SIDEWALKS REQUIRING REPAIR.
   It shall be the duty of every owner, agent, or occupant of any lot or parcel of land when notified by the Department of Public Services, to repair the sidewalks in accordance with this subchapter, to promptly comply with the notice, and repair the sidewalks as ordered. If the owner, agent, or occupant shall neglect or refuse to repair the sidewalk within the time specified in the notice, and if it shall appear, from the return and report of the notice made by the Department of Public Services that after proper service or publication of the notice the sidewalks have not been repaired by the parties notified within the 45 days prescribed in the notice, then the city may at once declare the owner, agent, or occupant of the premises so notified to be delinquent in the matter of repairing the sidewalk, and may order the sidewalk repaired by either the city or a contractor, as may be deemed best by the city. Any costs associated with the delinquency thereof will be charged to the owner; agent or occupant of the property constructed, and if not sooner paid by such owner, agent or occupant, will be assessed against the property as provided in this chapter.
