A. All commercial operators, as defined in § 72-8 of this chapter, shall provide proof of financial responsibility of the operator and its sureties sufficient to show clearly and convincingly the operator's competency to operate successfully.
B. Each such commercial operator shall provide at least the following insurance in amounts specified and underwritten by insurance companies approved by the Department of Banking and Insurance of the State of New Jersey, which shall include as an additional insured the Town of Hammonton as lesser and owner of the Hammonton Municipal Airport, and provide to lesser certificates of insurance in the following amounts and type which shall first be approved by the Town Insurance Risk Manager:
(1) Airport premises, products and completed operations liability:
(a) Bodily injury and property damage: $1,000,000 each occurrence, $2,000,000 aggregate.
(b) Fire damage liability: based upon individual exposure as determined by the Town Insurance Risk Manager.
(c) Medical expense coverage: $5,000 each person.
(2) One million dollars storage tank liability each occurrence with an annual aggregate of $1,000,000 listing the Town of Hammonton as additional insured for cleanup and removal activities arising from operating a fuel facility at the Hammonton Municipal Airport.
(3) Hangar keeper's legal liability: an amount equal to the single highest valued aircraft in the insurer's care, custody and control, with an aggregate limit equal to twice the foregoing limit.
(4) Worker's compensation. Worker's compensation insurance shall be provided in accordance with the Worker's Compensation Laws of the State of New Jersey.
(5) Aircraft liability:
(a) Bodily injury and property damage: $1,000,000 CSL.
(b) Bodily injury liability: $100,000 each passenger.
C. Said operator shall include as an additional insured the Town of Hammonton as lesser and owner of the Hammonton Municipal Airport, and provide to the lesser certificates of insurance in the following amounts and type which shall first be approved by the town's insurance broker of record:
(1) Products liability:
(a) $500,000 each accident.
(b) $1,000,000 aggregate.
(2) Aircraft liability (owned and non-owned):
(a) Bodily injury (excluding passengers):
[1] $500,000 each person.
[2] $1,000,000 each occurrence.
(b) Property damage, passenger: $100,000 each accident.
(c) Bodily injury liability: $100,000 each passenger seat.
(3) Hangar keeper's legal liability: An amount equal to the single highest valued aircraft in the insured's care, custody and control, with an aggregate limit equal to twice the foregoing limit.
(4) Worker's compensation: Worker's compensation insurance shall be provided in accordance with the Workers' Compensation Laws of the State of New Jersey.
D. The town reserves the right to require the operator to produce proof of assets or sufficient sureties to cover the entire rental for the term of the lease and to deny any request for a lease where such proof is not furnished.
