(A) Upon filing an application, as provided in § 125.20 (B), with an insurance policy or bond, as described in § 125.26, and a cash or certified check in full payment for the license fee, the City Controller (using reports from the Lake County Sealer of Weights and Measures and the Police Department) shall confirm that each vehicle to be licensed has met all prerequisites according to this chapter then shall thereupon issue to the applicant the following.
(1) A license for a specified taxicab authorizing that taxicab to operate within the city limits for a period specified in this chapter or, in the case of late issuance, for the remaining time of the prescribed annual period.
(2) The City Controller shall issue a numbered decal showing the licensee’s number and specific number assigned to the specific vehicle (taxicab). The decal shall be attached onto the taxicab’s rear window (left side). The decal shall not be transferred to any other vehicle.
(a) If a taxicab is to be retired before the expiration date of its license, the owner shall inform the City Controller within 10 days after the retirement of the vehicle. Any replacement for the retired vehicle must meet the requirements of this chapter and a new license must be issued.
(b) All violations of this chapter, except for fraud which shall result in an immediate revocation of a taxicab’s license, shall be corrected by the owner within 30 days from the date of notice of violation sent by the City Controller via certified mail. If corrections of the violation(s) are not made satisfactorily and timely, the taxicab’s license shall be revoked.
(B) (1) Not more than 50 taxicabs shall be licensed to operate at any 1 time in the city, and when that number of licenses shall be issued and outstanding the city shall refuse all other applications. However, no 1 taxicab operator shall hold more than 20 such licenses and no less than 4 taxicab licenses to operate.
(2) If any of the 50 licenses has not been requested before the annual deadline date for application by those who held them during that year, or if any licenses have been recalled because of violation of this chapter, the outstanding license(s) shall be made available by lotto drawing to those other licensee(s) not in violation who are holding less than 20 active city taxicab licenses.
(3) The City Controller shall conduct the lotto and shall invite present owners and, if necessary, new applicants to be present at the lotto drawing.
(C) The City Controller in issuing licenses for the current year shall give preference to the same number of licenses to those operators of taxicabs who shall have held licenses in the year immediately preceding the year for which a license is applied for.
