§ 119.12  FAILURE TO PERFORM REQUIRED INSPECTIONS NOT GROUNDS FOR DENIAL OF LICENSE APPLICATION.
   (A)   Notwithstanding any specific licensing ordinance to the contrary, a business license application shall not be denied solely on the grounds that the Police Department, Fire Department, Code Enforcement Officer or other appropriate official failed to perform the investigation necessary to determine the compliance of a premises with health, fire and building codes within the time frame for performing such investigation provided in an ordinance.
   (B)   It shall be grounds to deny a business license application if the premises to be used for the place of business have been disapproved as not being in compliance with health, fire and building codes by the department or official responsible for investigating such compliance within the time frame for performing such investigation provided in an ordinance.
