Emissions exceeding any of the limits established in this chapter as a direct result of upset conditions in or breakdown of any process, fuel burning, refuse burning, or control equipment or related operating equipment beyond the control of the person owning or operating the equipment shall not be deemed to be in violation of this chapter, provided, that the owner or operator immediately advises the Chief of the Department of Air Pollution Control of the circumstances and outlines a corrective program acceptable to the Chief.
