§ 90.007 OPEN BURNING.
   (A)   No person shall dispose of refuse by open burning or cause, suffer, allow or permit open burning of refuse, unless a permit therefor has been obtained from the Chief of the Department of Air Pollution Control. Any person required by this section to secure a refuse burning permit may apply for a continuing permit which, when issued, shall authorize the burning of combustible refuse during the period covered thereby, and the period shall not exceed 1 year.
   (B)   The open burning of refuse may be permitted when it can be shown by a person that the open burning is absolutely necessary and in the public interest. Any person intending to engage in open burning of refuse shall file a request to do so with the Chief. The application shall state, but shall not be limited to the following items.
      (1)   The name, address and telephone number of the person submitting the application;
      (2)   The type of business or activity involved;
      (3)   A description of the proposed equipment and operating practices, and the type, quantity, composition and amount of air contaminants to be released to the atmosphere;
      (4)   The schedule of burning operations;
      (5)   The exact location where the open burning may be carried on;
      (6)   The reason why no method other than open burning can be used for disposal of the trade waste; and
      (7)   Evidence that the proposed open burning has been approved by the Fire Department.
   (C)   The Chief may, in his or her discretion, impose other reasonable conditions necessary to prevent the creation of a nuisance.
   (D)   No person shall conduct, cause or permit the conduct of a salvage operation by open burning.
