§ 51.190 FAILURE TO COMPLY WITH TERMS OF CHAPTER.
   (A)   The POTW may suspend the wastewater treatment service and/or an industrial wastewater contribution permit where the suspension is found necessary by the POTW, in order to stop an actual or threatened discharge which presents an imminent or substantial endangerment to the health or welfare of persons, or to the environment, has caused interference to the POTW or has caused violation of any condition of the POTW NPDES permit. There is an imminent or substantial endangerment to the health or welfare of persons, only informal (not written) notice is required before stopping an industrial user’s discharge.
   (B)   Any person given written notice of a suspension of the wastewater treatment service and/or the industrial wastewater contribution permit, shall immediately cease and desist, to eliminate the contribution. In the event of a failure of the person to comply voluntarily with the suspension order, the POTW shall take such steps as deemed necessary including immediate severance or the sewer connection, to prevent or minimize damage to the POTW system or endangerment to any individuals. The POTW may reinstate the wastewater contribution permit and/or the wastewater treatment service upon proof of the elimination of the discharge. A detailed written statement shall be submitted by the user describing the causes of the harmful contribution and the measure taken to prevent any further occurrence and shall be submitted to the POTW within 7 days of the date of occurrence.
   (C)   Any person having wastewater treatment service terminated, and/or an industrial wastewater contribution permit suspended, by a finding and determination of the POTW, shall be afforded an appeal and hearing with the POTW within 24 hours after the termination and/or suspension. The appeal hearing shall be conducted so as to confirm whether or not the determination of the city’s Sanitary District, as to the severity of the discharge or endangerment that led to the termination of service and/or suspension of permit, is proper and to identify requirements necessary to reestablish service and/or the permit.
