§ 51.121 SERVICE PIPE CONNECTION WHERE STREET, ALLEY TO BE IMPROVED; NONCOMPLIANCE.
   (A)   The Board of Public Works and Safety of the city is authorized, directed and instructed, whenever the Board shall deem it expedient to pave or improve any roadway, street, part of a street or alley to provide by resolution, the number, location and kind of all service pipes for sewer and water connections necessary to accommodate the abutting property, the material to be used and the manner of laying the material, from the mains in the street to a point inside of the lot line of the roadway of the street, in the declaratory resolution authorizing the improvement or subsequent thereto. The Board shall give notice by publication in a daily newspaper in the city for 2 successive days to the owners of the abutting property, to make the connections in the manner provided in the resolution, within 14 days from the last publication of the notice.
   (B)   If the connections required by division (A) above are not made and laid as specified within the specified time, the Board of Public Works and Safety of the city is hereby directed, authorized and instructed to cause the connections as provided in the resolution to be made.
   (C)   The cost thereof shall be a lien on the real estate of the property abutting thereon, and shall be collected in the same manner as assessments for street improvements are now collected by law. However, in all cases upon the completion of the connections by the Board, the Board shall cause an assessment roll to be prepared and shall give notice of a special hearing thereon and shall determine at that time and place the question of special benefits, arising from and by reason of the improvements as provided by state law. These assessments, after the hearing, shall be certified as other special assessments are referred for collection; provided, that the privilege of paying the assessments for the connections in annual installments shall not apply to the assessments for the connections.
