(A) Significant industrial users shall provide protection from accidental discharge of materials which may interfere with the POTW by developing spill prevention plans. Facilities deemed necessary to implement these plans shall be provided and maintained at the owner’s or industrial user’s expense.
(B) Spill prevention plans, including the facilities and the operating procedures, shall be submitted within 90 days after the effective date of this chapter and be reviewed by the District. The District will reply within 90 days after receipt of the plan. New sources must have their plan approved before construction of the facility. Industrial users that store hazardous substances shall not contribute to the POTW 18 days after the effective date of this chapter unless a spill prevention plan has been approved by the District. Approval of such plans shall not relieve the industrial user from complying with all other laws and regulations governing the use, storage and transportation of hazardous substances.
(C) The Spill Prevention Plan shall be updated annually and submitted to the District no later than February 1 of each calendar year. The Plan shall be accompanied by a compliance affidavit stating that the Plan has been reviewed and updated, and shall be signed by the highest ranking official at the industrial user’s location.
