§ 51.026 ACCIDENTAL DISCHARGES.
   (A)   Each industrial user shall provide protection from accidental discharges of materials that may interfere with the POTW, and shall develop an accidental discharge and spill prevention plan. If required under Title 40 C.F.R. § 403.5(b), each industrial user also should include a Slug Control Plan. Facilities deemed necessary to implement these plans shall be provided and maintained at the owner’s or industrial user’s expense. The plan, including the facilities and operating procedures, shall be submitted within 180 days of the effective date of this chapter and shall be reviewed by the city’s Sanitary District. The District shall reply within 90 days after receipt of the plan. The Accidental Discharge, Slug Control and Spill Prevention Plan shall be implemented as soon as possible, but no later than 12 months after start of operation. Approval of the plans shall not relieve the industrial user from complying with other laws and regulations governing the use, storage and transportation of hazardous substances. The Plan shall be updated whenever there is a significant change in facility design, construction, operation or maintenance, but no less than every 3 years, and shall be filed with the District.
   (B)   No user who commences contribution to the District shall be permitted to introduce pollutants into the system 180 days after the effective date of this chapter until accidental discharge procedures have been approved by the District. Review and approval of such plans and operating procedures shall not relieve the industrial user from the responsibility to modify the industrial user’s facility as necessary to meet the requirements of this chapter. Industrial users who are also required to submit to the District a Spill Prevention Plan, may incorporate their Accidental Discharge Plan into the Plan. Each industrial user that has an accidental discharge, upset (as per Title 40 C.F.R. § 403.16), bypass (as per Title 40 C.F.R. § 403.17), or any discharge that could cause problems to the POTW, including any slug loadings, the user shall immediately telephone and notify the POTW of the incident. The user shall be required to pay a surcharge covering the cost of investigation, monitoring and treatment of the prohibited material that was accidently discharged. In addition, the notification shall include location of discharge, type of waste, concentration and volume and corrective actions.
