(A) This chapter sets forth uniform requirements for Users of the Publicly Owned Treatment Works (POTW), and enables the District to comply with all applicable state and federal laws required by the Clean Water Act of 1977 General Pretreatment Regulations (Title 40 C.F.R. part 403) and the latest revision thereto. The objectives of this chapter are:
(1) To prevent the introduction of pollutants into the municipal wastewater system which will interfere with the normal operation of the system or contaminate the resulting sludge;
(2) To prevent the introduction of pollutants into the POTW which do not receive adequate treatment in the POTW, and which will pass through the system into receiving water or the atmosphere or otherwise be incompatible with the system;
(3) To improve the opportunity to recycle and reclaim wastewaters and sludge from the system;
(4) To empower the investigation and abatement of violations of this chapter and provide for the establishment and enforcement of standards, rules and regulations, and the authority to take samples and conduct tests, and to establish the right of entry;
(5) To establish authority for industrial user reporting;
(6) To establish the persons liable for violations and provide for fines for violation of the provisions of this chapter, and provide just and adequate means of which this chapter be executed;
(7) To regulate the direct and indirect discharges to the municipal wastewater system through the issuance of discharge permits and through enforcement of general requirements to all users; and
(8) To provide for the setting of fees for the equitable distribution of costs resulting from the program established herein.
(B) This chapter shall apply to the city’s Sanitary District and to communities outside the District who are, by contract or agreement with the District, users of the Districts’ POTW. This chapter is a revision of Ord. 4996 and a supplement to Ord. 4290 as amended. Except as otherwise provided herein, the District Manager of the city’s Sanitary District Facilities shall administer, implement and enforce the provisions of this chapter.
