§ 32.45 CITY JAIL BOOKING AND PROCESSING FEE.
   (A)    Any individual, who upon arrest for a criminal or civil matter, including but not limited to a criminal or civil warrant, custodial arrest, probable cause hold or surrender, and is thereby booked and processed at the city jail, shall remit to the city jail, from his bond, commissary account or other funds a $30 dollar city jail booking and processing fee.
   (B)   A receipt showing the collection of these funds shall be provided to the arrestee or his designee. A copy of the city jail booking and processing fee ordinance shall be posted in a conspicuous location in the booking area and a copy of this ordinance shall be provided to the arrestee upon request.
   (C)   Any individual who has paid the city jail booking and processing fee and is able to demonstrate that he/she was arrested without probable cause (released with no charges filed); was acquitted; or arrested only on charges that were dismissed for a lack of merit, as opposed to charges dismissed pursuant to a plea in another cause, or under a supervision agreement, is entitled to file a claim with the city for refund or reimbursement of the city jail booking and processing fee, and request a hearing before the Board of Public Works and Safety. In cases where arrestee is indigent, as determined by the court upon examination under oath, the arrestee may additionally petition for waiver, refund, or reimbursement of the city jail booking and processing fee.
