§ 33.01 MUTUAL AID BETWEEN POLICE DEPARTMENTS.
   (A)   The City Police Department is authorized to give and request mutual aid from the cities of Carthage, Warsaw, and/or Nauvoo upon and after adoption of the ordinance codified in this section by those cities.
   (B)   Mutual aid, given or requested, is to be provided or received by the Police Department of the city only as to those cities adopting this section and only after approval for the giving or receiving of such aid by the City Council except in an emergency situation.
   (C)   In an emergency situation where the life of a police officer or any other person is threatened in some manner or in a situation where a police officer or other person is in immediate danger of grave bodily harm or in a situation where property is threatened, the Chief of Police, if available, or the officer on duty, if the Chief is not available, is authorized to request or provide mutual aid to cities adopting the ordinance codified herein without prior approval of the City Council, under division (B) above.
   (D)   Mutual aid shall consist of the dispatching of one or more officers, cars, and equipment from the responding Police Department to the requesting Police Department.
   (E)   Mutual aid shall not be binding or obligatory on the responding city and whether to send aid shall be subject to the sole discretion of the responding city, considering the circumstances of the situation and the need for officers to remain on duty in the responding city.
   (F)   Whenever any responding police officers of any city adopting the provisions of this section are engaged in a response in the requesting city, they shall have the same powers, duties, privileges, rights, and immunities as members of the Police Department of the requesting city, subject to the provisions herein. They shall have the authority of the police of the requesting city and of a peace officer within the territorial jurisdiction of the requesting city.
   (G)   Officers of a responding aid city shall be under the direction and control of the Chief of Police or officer in charge in the requesting city.
   (H)   For purposes of worker’s compensation, the responding police officer remains the employee of his or her city and is not a joint employee with the requesting city. The cost of salary and benefits accruing to a police officer, and the cost of damage incurred to vehicles or equipment owned by a police officer or his or her employing city while performing duties as a provider under this section shall be borne by the police officer’s own employing city or the police officer if the equipment is owned by the police officer.
