§ 155.03 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BUILDING LINE. A line on a plat between which line and a street no building or structure may be erected.
   CUL-DE-SAC. A minor street with only one outlet and culminated by a turnaround.
   EASEMENT. A grant by the property owner of the use, for a specific purpose, of a strip of land by the general public, a corporation, or a certain person or persons.
   ESCROW AGREEMENT. An agreement between the subdivider and the city, whereby the contractor guarantees installation of all public utilities proposed in plans.
   LOT. A portion of a subdivision or other parcel of land intended for the purpose, whether immediate or future, of transfer of ownership or of building development.
   MAJOR STREET. A street designated as a major street in the Major Street Plan for Hamilton.
   MINOR STREET. A street not designated as a major street in the Major Street Plan for Hamilton.
   PERFORMANCE GUARANTEE. Cash deposit or escrow agreement made out to the city in an amount equal to the full cost of the improvements which are required by this chapter, the cost being estimated by the City Engineer and the cash deposit or escrow agreement being legally sufficient to secure the city that the improvements will be constructed in accordance with this chapter. In lieu of escrow agreement, the subdivider may install all public utilities proposed in plans after meeting all requirements in §§ 155.22(C) and 155.24. The resolution accepting the plat and recording of the plat will be done upon certification by the City Engineer and City Attorney of satisfactory completion of the installation and construction of all the required improvements and acceptance of the required improvements by the City Council. Prior to certification by the City Engineer and City Attorney, the subdivider shall file with the City Engineer plans, profiles, and cross-sections of the required improvements as they have been built.
   ROADWAY. The portion of the street available for vehicular traffic and, where curbs are laid, the portion from back to back of curbs.
   STREET. All property dedicated or intended for public or private use for access to abutting lands or subject to public easements therefor and whether designated as a street, highway, thoroughfare, parkway, throughway, expressway, road, avenue, boulevard, lane, place, circle, or however otherwise designated.
   SUBDIVIDER. Any person, individual, firm, partnership, association, corporation, estate, trust, or any other group including any agent thereof or combination acting as a unit dividing or proposing to divide land so as to constitute a subdivision as defined herein.
   SUBDIVISION. The division of land into two or more lots or other division of land into parcels of one acre or less in area for the purpose, whether immediate or future of transfer of ownership or building development or any change in existing street lines or public easements. The term, when appropriate to the context, relates to the process of subdividing or to the land subdivided or the re-subdivision of land heretofore divided or platted into lots or other divisions of land or, if a new street is involved, any division of land.
