§ 125.04 ISSUANCE, DENIAL AND APPEAL OF DENIAL OF LICENSE.
   (A)   The Town Planner shall issue to the applicant a license for an extended hours convenience store if the Town Planner determines that:
      (1)   The applicant has complied with all requirements for issuance of the license; and
      (2)   The applicant has not made a false statement as to a material matter in any application for a license.
   (B)   If the Town Planner determines that the requirements of division (A) of this section have not been met the Town Planner shall deny a license to the applicant. If the Town Planner determines that an applicant should be denied a license, the Town Planner shall deliver written notice to the applicant that the application is denied and include in the notice the reason for denial and a statement informing the applicant of the right of appeal.
   (C)   A license issued under this section must be displayed to the public in a manner and location approved by the Town Planner. The license must be presented upon request to any Town official for examination.
   (D)   No license shall be granted or renewed for any extended hours convenience store on which taxes, assessments or other financial claims of the town of Hamden are delinquent or unpaid (if due).
