A. Any duly authorized police officer of the city shall have the right at any time to make an examination of the premises of any beverage catering permit holder as to whether the laws of the state and the ordinances of the city are being complied with.
B. Any police officer of the city who should find any liquor, beer or wine, or any combination thereof, kept or held by any person in violation of the provisions of this chapter or Idaho Code section 23-901 et seq., may forthwith seize and remove the same and keep the same as evidence and, upon conviction of the person for violation of the provisions hereof, the said liquor, beer or wine and all packages or receptacles containing the same shall be forfeited to the state of Idaho and, in addition, the person so violating this chapter or Idaho Code section 23-901 et seq., shall be subject to the other penalties herein prescribed.
