15.16.120.12: RECALCULATION:
If development impact fees are calculated and paid based on a mistake or misrepresentation, they shall be recalculated. Any amounts overpaid by a fee payer shall be refunded by the city within thirty (30) days after the city's acceptance of the recalculated amount, with interest at the legal rate provided for in Idaho Code section 28-22-104 from the date on which the fee was paid. Any amounts underpaid by the fee payer shall be paid to the city within thirty (30) days after the city's acceptance of the recalculated amount, with interest at the legal rate provided for in Idaho Code section 28-22-104 from the date on which the fee was paid. In the case of an underpayment to the city, the city may withhold issuance of the building permits or development approvals for the project for which the development impact fee was paid until such underpayment is corrected, and if amounts owed to the city are not paid within such thirty (30) day period, the city may also revoke any building permits or development approvals issued in reliance on the previous payment of such development impact fee and refund such fee to the fee payer.
