3-1-3: PUBLIC DISPLAY; PERMIT REQUIREMENTS; FEE:
   A.   Application For Permit: Any person seeking authority for the public display of nonaerial common fireworks outside the sales period permitted in section 3-1-4 of this chapter, or of fireworks other than nonaerial common fireworks at any time, may file an application with the city clerk-treasurer on a form approved by the city council for such activity.
   B.   Information Required: Any such application shall contain the same information required by section 3-1-2 of this chapter and shall also set forth the site for the public display and all security arrangements for the protection of persons and property in connection with such public display. Types of fireworks and uses in connection with the public display shall also be set forth in the application.
   C.   Liability Insurance Required: Every such application shall be accompanied by a valid certificate of public liability and property/casualty insurance providing for coverage of one million dollars ($1,000,000.00) for injury to persons and/or damage to property within time for the public display of the fireworks.
   D.   Application Fee: Every such application shall be accompanied by a nonrefundable fee as set by resolution of the city council.
   E.   Council Consideration; Permit Issuance Or Denial: The fire chief shall consider the application and, if he determines it to be consistent with the provisions of this chapter, and Idaho Code section 39-2601 et seq., shall make a recommendation to the city council. The city council shall issue a permit or not, in its sole discretion.
   F.   Permit Nontransferable: Any permit issued shall not be transferable by the applicant.
   G.   Conduct Of Public Display: The applicant may conduct public display of fireworks in accordance with the application and permit on the date therein provided. (2010 Code)
