A. Permit For Retail Sales: No person shall sell at retail within the city any nonaerial common fireworks without a permit first having been issued to that person by the city clerk-treasurer.
B. Required Information: Any person seeking a permit to sell nonaerial common fireworks at retail shall be required to complete and file an application on a form to be provided by the city clerk-treasurer, approved by resolution of the city council. The application shall contain, without limitation, the following:
1. The name and address of the applicant, including the names of all partners if a partnership, the names of all officers and directors if a corporation and the names of all members if a limited liability company;
2. The primary location of the applicant;
3. Specific street address for each location at which fireworks to be sold under the permit are to be stored; and
4. If applicable, the seller's Idaho sales tax seller's permit number.
C. Insurance Requirements: Each application shall be accompanied by a valid certificate showing public liability and property/casualty insurance in force with minimum coverage of one hundred thousand dollars ($100,000.00) for the activities to be conducted by the applicant.
D. Nonrefundable Fee: Each application shall be accompanied by a nonrefundable fee in such amount as set by resolution of the city council.
E. Issuance; Permit Nontransferable: The fire chief and the city clerk-treasurer shall review each application and, if it is complete and complies with the terms of this chapter, and the provisions of Idaho Code section 39-2601 et seq., shall issue a permit allowing retail sales in accordance with this chapter, and Idaho Code section 39-2601 et seq., which permit shall not be transferable.
F. Display: Every permit issued shall be displayed prominently in public view at the location listed on the permit. (2010 Code)
