§ 97.10 REGULATIONS AND PERMITTED USES.
   (A)   La Lomita hours of use shall be 7:00 a.m. to 7:00 p.m., unless a permit is obtained in advance from the Town Manager prior to such use.
   (B)   No fees shall be charged for the issuance of the permit.
   (C)   Permitted uses are reflection, meditation, prayer, small religious ceremonies and other small gatherings for uses consistent with the purposes stated herein.
   (D)   The use of La Lomita by any one group or person may not last more than two hours on any given day unless a permit has been obtained prior to the use.
   (E)   Unless a permit has been obtained the use of La Lomita by any person or group shall be on a first come first served basis and shall not block access, or prevent the simultaneous use of La Lomita by another person or group if such uses are not incompatible.
   (F)   There shall be no sleeping, camping or overnight stays at La Lomita unless a permit has been obtained from the Town Manager. Overnight candlelight vigils or similar events are allowed with a permit.
   (G)   Anyone who enters upon the La Lomita grounds in violation of these rules or remains thereon unlawfully may be charged with trespassing pursuant to A.R.S. § 13-1502 et seq.
   (H)   There shall be no loud noises, fireworks or disorderly conduct at La Lomita in violation of A.R.S. §13-2904(A)1-5.
   (I)   Anyone who causes criminal damage at La Lomita as defined in A.R.S. § 13-1601 et seq. may be charged with a criminal misdemeanor as set forth in A.R.S. §§ 13-1602(A)(1), (2) and (5) and 13-1602(B)(5) and (6).
   (J)   Anyone who commits criminal littering at La Lomita as defined in A.R.S. §§ 13-1601(3), 13-1603(A)(1), (2) and (3), may be charged with a class one criminal misdemeanor as set forth in A.R.S. 13-1603(B)(2) and (3) and a class two criminal misdemeanor if charged under A.R.S. 13-1603(B)(4).
   (K)   The Town Manager, or designee, shall enforce these rules. Permit requests must be made not less than ten days prior to the event.
   (L)   Before any permit is issued, the Town Manager shall consider the impact of the proposed event on the surrounding neighborhood and the impact to other possible users of La Lomita while the proposed use or event would be underway.
   (M)   The decision of the Town Manager or any permit request shall be final.
   (N)   The legal description of La Lomita is attached to Ordinance O2020.01 as Exhibit A, Special Warranty Deed dated November 26, 2007, and incorporated by reference as if fully set forth herein.
   (O)   This section shall take effect 30 days after its adoption. Enforcement shall not occur until after appropriate signage related to this section has been posted at La Lomita.
