§ 92.99 PENALTY.
   (A)   Any person failing to comply with a notice of violation or order served in accordance with this chapter shall be deemed guilty of a civil infraction as determined by the local municipality, and the violation shall be deemed a strict liability offense. If the notice of violation is not complied with, the Borough of Grove City shall institute the appropriate proceeding under this chapter. Any person, firm or corporation violating any of the provisions of §§ 92.01 through 92.07 shall be sentenced to pay a fine of not less than $75 nor more than $500 for the first two uncorrected violations of the same section on the same property in the same calendar year and not less than $150 nor more than $1,000 for the third and any subsequent uncorrected violations of the same section of the code on the same property in the same calendar year, plus court costs and any expenses incurred by Grove City Borough for remediation thereof. Each day that a violation continues after due notice has been served shall be deemed a separate offense punishable by a separate fine as set forth herein.
   (B)   Any owner, occupant or lessee who shall fail to comply with any notice from the officer and/or order of the Borough Council to remedy, repair, vacate or demolish any condition or structure found to be in violation of §§ 92.25 to 92.30 or who violates any of the other provisions of §§ 92.25 to 92.30 shall, upon conviction before a District Justice, be subject to a fine not exceeding $300 plus costs, and in default of payment of the fine and costs, shall be subject to imprisonment for a period not to exceed 30 days. Each day of a violation shall be considered a separate violation and offense.
