§ 92.25 GENERAL PROVISIONS
   (A)   Short title. This subchapter shall be known as and may be cited as the "Borough of Grove City Property Nuisance Ordinance."
   (B)   Statement of findings. The governing body of the borough finds that:
      (1)   The borough recognizes the need to establish certain minimum health, safety and welfare requirements for certain conditions, buildings, structures or properties so as not to constitute a nuisance;
      (2)   Potentially hazardous or dangerous conditions to the general public which interfere with normal use and enjoyment of property in the borough may exist within the borough or may come to exist in the future so as to constitute a nuisance; and
      (3)   The Pennsylvania General Assembly, through enactment of the Borough Code, has vested the Council with the power to regulate the foregoing pursuant to 8 Pa.C.S. § 1202.
   (C)   Purpose. The purpose of this subchapter is to promote health, safety, and welfare within the borough by codifying:
      (1)   The duty of private property owners to ensure that their properties do not present a material interference with or danger to public health, public safety, public welfare, public comfort or public convenience so as to constitute a nuisance;
      (2)   The procedure for determination that a condition on, in or of a property or the property itself is a nuisance which must be abated;
      (3)   The procedure for notifying the property owner and others of the determination that his or her property has been determined to be a nuisance, and providing him or her with an opportunity to abate the condition; and
      (4)   The remedies and measures available to the Borough Council should the nuisance remain unabated after the notice period has expired.
   (D)   Statutory authority. The Borough Council is empowered to enact this subchapter by the Borough Code at 8 Pa.C.S. § 1202, which grants specific powers to Pennsylvania boroughs, including but not limited to, the power to prohibit and remove any nuisance or dangerous structure on public or private grounds, and the power to make regulations as may be necessary for the health, safety, morals, general welfare and cleanliness and beauty, convenience, comfort and safety of the borough and its residents.
