935.06   PROVISION OF PRETREATMENT.
   (a)   Upon notification by the Director of Public Service of the person responsible for discharges into the sewerage or drainage system that require pretreatment, the person responsible for such discharge shall:
      (1)   Within seven calendar days of notification, submit to the Director a scheduled program of installing pretreatment equipment and/or procedures. The program shall describe the steps to be taken to provide pretreatment and the anticipated schedule of implementation of each step.
      (2)   Implement the scheduled program upon acceptance by the Director.
      (3)   Notify the Director at monthly intervals as to his progress in implementing the program.
      (4)   Submit detailed plans, specifications and sufficient design information to allow proper evaluation of proposed pretreatment facilities for approval prior to construction. Such approval by the Director shall signify that best engineering judgment indicates that the proposed facilities will be capable of providing satisfactory pretreatment. Such approval does not, in any way, guarantee that the facilities will function satisfactorily, or that it will not be necessary to enlarge or otherwise modify the facilities to make them capable of providing satisfactory pretreatment. It remains the responsibility of the person submitting or causing the submission of the information to assure compliance with all discharge limitations.
      (5)   Operate and maintain the pretreatment facilities in accordance with and meet the requirements of Chapter 937.
      (6)   Maintain such records and perform such tests as required by the Director of the character of the influent and effluent.
   (b)   The Director may order removal of the unacceptable discharge from the sewerage or drainage systems at any time during pretreatment program implementation if unsatisfactory progress is evident or if necessary to protect the sewerage or drainage systems from damage.
