(a) No person shall, with intent to defraud, after requesting and obtaining food, refreshment or other merchandise or services at any public house, restaurant or other business establishment, fail or refuse to pay therefor. Departure from such establishment without having paid the charge for the goods or services furnished or making arrangements for such payment, satisfactory to the person in charge, shall be evidence of intent to defraud.
(b) Whoever violates this section is guilty of departure without paying for goods or services, a misdemeanor of the fourth degree.
